E., C., In Re: Hinds Chancery Court 1st District; LC Case#: AB9132; Ruling Date: 01/05/2000; Ruling Judge: Denise Owens; Disposition: On Court's own motion, on appeal from the denial of waiver of parental consent requirement for abortion sought by a minor, this matter is remanded to the Chancery Court of the First Judicial District of Hinds County for further proceedings consistent with this order. The chancery court shall determine whether the petitioner is represented by counsel and, if not, appoint counsel. As soon as possible, but in no event later that ten days following the entry of this order, the chancery court shall afford petitioner a full evidentiary hearing, the testimony in such proceedings to be recorded and transcribed. The chancery court shall thereafter make specific written findings of facts and conclusions of law. No later than thirteen days following entry of this order the complete record with a transcript of the testimony, a certified judgment and the chancellor's findings of facts shall be filed with the Clerk of this Court for further proceedings on appeal. If it appears that the chancellor who entered the order appealed is unavailable or unable to proceed within the time limits provided for herein, the senior chancellor of the district shall assign another chancellor to conduct the proceedings on remand.
