Board of Education of Calhoun County, Mississippi, In Re: Calhoun Chancery Court; LC Case#: 91-288; Ruling Judge: C. Malski; Disposition: In August 2001, this Court entered an order granting an application for writ of mandamus filed by the Board of Education of Calhoun County, which directed Special Judge Michael Malski to rule on post-trial motions pending in Cause No. 91-288, Calhoun County Chancery Court. No order was entered within the time specified and on December 7, 2001, this Court directed Special Judge Malski to show cause why he should not be sanctioned for failure to comply with the Court's order. Malski in response entered his decision on the post-trial motions in Cause No. 91-288. On Court's own motion and the order to show cause, the Court now finds that sanctions are not warranted against Special Judge Michael Malski in this case. McRae, P.J., would grant sanctions. Easley, J., not participating. Order entered.
