Townsend, Bobby Joe v. State of Mississippi Webster Circuit Court; LC Case#: 4432; Ruling Date: 01/21/1999; Ruling Judge: C. Morgan, III; Disposition: Townsend's Motion to Remand for Crime Lab Testing and Supplementation of the Record with Previously Undisclosed Crime Lab, Medical, and other Evidence, or in the Alternative, Application for Leave to File Proposed Motion for Post-Conviction Relief, granted. This matter is remanded to the Webster County Circuit Court for a period of ninety days for further testing of the physical evidence, a hearing on whether a new trial should be granted based upon newly discovered evidence, and supplementation of the record. The circuit court shall provide access to the physical evidence in this case to a reputable and competent laboratory of Townsend's choice under such directions as the circuit court may impose, consistent with this order. Thereafter, the circuit court shall conduct a hearing, within ninety days of the entry of this order, for supplementation of the record regarding the results of such testing and for consideration of whether a new trial is warranted. The circuit court shall file a certified copy of its findings in this Court within fifteen days of the hearing. If the circuit court grants a new trial in this case, the appeal in this matter shall be dismissed. If the circuit court denies Townsend's request for a new trial, the record shall be supplemented with the newly discovered evidence and the transcript of the hearing in this matter shall be prepared and transmitted to this Court within thirty days of the trial court's decision for consideration on direct appeal. On Court's own motion, briefing shall be suspended pending resolution of this matter in the trial court. Should the trial court deny Townsend's request for a new trial, briefing shall resume upon receipt of the supplemental volume. Smith, J., would deny. Order entered.
