Mark Dwayne Sumrell is granted leave to proceed in the Washington County Circuit Court for an evidentiary hearing to determine whether he did, in fact, serve one year for robbery in Cause No. 22,242. The trial court shall make its determination as set out in the Order. The Washington County Circuit Court will seasonably appoint counsel to represent Sumrell at the hearing. If the trial court determines that Sumrell did not serve one year for robbery in Cause No. 22,242, then it shall vacate his sentence of life without parole under Mississippi Code Section 99-19-83 and resentence him.
