Roger McMillin announces retirement from Court of Appeals Chief Judge Roger H. McMillin Jr. announced Wednesday that he is retiring from the Mississippi Court of Appeals effective April 30, 2004. He is leaving the Court to pursue an opportunity in the private sector. Judge McMillin, 58, is one of the original members of the Court of Appeals, having been first elected to the Court in November 1994 from the 1st Congressional District. The district encompasses parts of 23 counties from the Tennessee border to Choctaw County. He served as Chief Judge of the Court of Appeals for the past five years. "It has been an honor to serve the people of Mississippi in this position for the past nine and a half years and I am quite proud of the work the Court has done during my tenure. I am certain the good work of the Court will continue through the efforts of the dedicated judges now serving on the Court," Judge McMillin said. The Governor will appoint someone to the vacancy created by Judge McMillin's retirement. More than six and a half years remain on the term, which was scheduled to expire in January 2011. A special election will be held in November 2006. The statute which sets out the manner of filling judicial vacancies is Mississippi Code Section 23-15-849. The Chief Justice of the Supreme Court will select a new Chief Judge for the Court of Appeals from among the members of the Court of Appeals, according to Mississippi Code Section 9-4-7.
